1. Agreement to Terms
These Terms govern your use of the OpsBuilt Service. By accessing or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
2. Service Description
OpsBuilt provides a cloud-based shop management system for graphic, print, apparel, and related businesses.
Features may include quoting, sales orders, invoicing, customer management, production tracking, file storage, and integrations.
3. Account Requirements
To use the Service, you must:
- Be at least 18
- Provide accurate information
- Maintain account security
- Be legally able to enter a contract
You are responsible for user accounts associated with your tenant.
4. Subscription & Billing
- Access to OpsBuilt requires a paid subscription.
- Billing is processed through Stripe.
- Subscriptions auto-renew until cancelled.
- You may cancel at any time.
- We do not issue refunds for partial billing periods.
- Trials (7 days) are offered once per tenant.
Users are responsible for cancellation timing.
5. Customer Payments (Square)
OpsBuilt tenants may accept payments from their customers through Square. OpsBuilt does not settle funds, control payouts, or assume liability for financial disputes between tenants and their customers.
6. Data Ownership
Users own their operational data. OpsBuilt licenses the software only.
7. Data Retention & Export
Upon subscription cancellation:
- Data remains available for 90 days for export
- After 90 days, data may be deleted
- Users may request earlier deletion
8. Acceptable Use
You agree not to:
- Misuse the Service
- Reverse-engineer
- Circumvent access controls
- Resell or sublicense access
- Upload malicious code
- Use the Service for illegal purposes
We may suspend accounts violating these terms.
9. Automation & Decision Support
OpsBuilt may include automated pricing assistance, suggestions, calculations, and workflows. Users are solely responsible for verifying business and financial decisions. OpsBuilt does not make binding legal, tax, or financial decisions.
10. Modifications to the Service
We may:
- Modify features
- Add integrations
- Remove deprecated components
- Improve performance
- Update technical architecture
Without obligation to provide prior notice.
11. No Warranty
OpsBuilt is provided “as is” and “as available.”
We do not guarantee:
- Uptime
- Accuracy of data
- Availability of third-party APIs
- Fitness for any purpose
12. Limitation of Liability
To the maximum extent permitted by law:
- OpsBuilt is not liable for indirect, incidental, consequential, or punitive damages.
- Total liability shall not exceed the amount paid during the 3 months prior to claim.
13. Indemnification
You agree to indemnify OpsBuilt against claims arising from misuse of the Service.
14. Governing Law
These Terms are governed by the laws of the State of West Virginia, USA.
15. Termination
We reserve the right to suspend or terminate accounts violating these Terms. Cancellation may be initiated by the user at any time.
